MachVerity (“MachVerity,” “we,” “us,” or “our”) operates the website at machverity.com and related tools (the “Service”). The Service lets you look up heavy equipment and vehicles by serial number, product identification number (PIN), or VIN and view aggregated reference information such as identity, an estimated market value, and title, lien and theft indicators. By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your use of the Service and for complying with all applicable laws.
3. Reference tool only
The Service aggregates information from public records, third-party data providers, and user contributions. It is provided for general informational and reference purposes only. It is not an inspection, appraisal, certification, title search, lien search, or theft determination, and it does not create any professional or fiduciary relationship between you and MachVerity.
4. Not professional advice
Nothing on the Service is legal, financial, tax, insurance, or valuation advice. Before buying, selling, financing, insuring, or otherwise relying on a machine’s status or value, you must independently verify the information through official and authoritative sources, including manufacturer records, official title and registration authorities, NMVTIS (for on-road vehicles), UCC and other lien filings, and law enforcement for theft. 5. No warranty of accuracy
The Service and all information in it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Data may be incomplete, outdated, or incorrect. The absence of a lien, theft, or title flag does not mean a machine is free of liens, has not been stolen, or has a clean title.
6. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- scrape, harvest, crawl, or bulk-extract data from the Service, or use automated means to access it beyond normal individual lookups, except with our prior written permission;
- resell, sublicense, or commercially redistribute data obtained from the Service;
- reverse engineer, interfere with, or attempt to gain unauthorized access to the Service or its infrastructure;
- submit false, misleading, defamatory, or infringing information, or use theft or lien indicators to harass, defame, or threaten any person; or
- impose an unreasonable load on the Service.
7. Your contributions
The Service may let you submit equipment records, corrections, watch requests, and theft or lien reports (“Contributions”). You represent that you have the right to submit each Contribution and that it is accurate to the best of your knowledge. You grant MachVerity a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, store, reproduce, modify, aggregate, publish, and display your Contributions in connection with operating and improving the Service. We may review, moderate, edit, or remove Contributions at our discretion, but we are not obligated to. Do not include sensitive personal information in Contributions, as records may be displayed publicly.
8. Theft & lien reports
Any theft, lien, or title indicator shown on the Service, including those derived from user reports, is informational only and is not a legal determination or an accusation against any person. Reports may be inaccurate or unverified. If you believe equipment has been stolen, contact law enforcement. If you are affected by a report you believe is incorrect, contact us at [email protected].
9. Intellectual property
The Service, including its design, text, graphics, logos, the MachVerity name and marks, and the compiled database, is owned by MachVerity or its licensors and is protected by intellectual property laws. Except for your own Contributions, you receive no ownership rights. You may not use our name or marks without permission.
10. Third-party data and links
The Service relies on and may link to third-party sources and services. We do not control and are not responsible for third-party data, content, or availability. Your use of third-party services is subject to their terms.
11. Limitation of liability
To the maximum extent permitted by law, MachVerity and its owners, contributors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of, or inability to use, or reliance on the Service or any information in it, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability for all claims relating to the Service is limited to CAD $100.
12. Indemnification
You agree to indemnify and hold harmless MachVerity and its owners and contributors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your Contributions, or your violation of these Terms or of any law or third-party right.
13. Changes to the Service and Terms
We may modify or discontinue the Service, or update these Terms, at any time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada, subject to any mandatory consumer-protection rights you may have in your place of residence. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
